Acceptance of Terms

By accessing or using OHWOW.FUN (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Service Description

OHWOW.FUN provides an AI-powered agent workforce platform for solo founders and small businesses. The Service includes AI agents that perform tasks on your behalf, including content creation, email drafting, data analysis, and other business operations. AI-generated outputs should be reviewed before use.

Account Security

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

Subscription Plans & Data Usage by Tier

Trial & Starter Plans

Subject to usage limits as described on the pricing page. Anonymized usage analytics may be collected unless you opt out in your settings. Your data is never used for AI model training. Trial accounts are limited to 25 tasks.

Pro Plan

Higher usage limits, scheduled execution, and all integrations. Your data is never used for AI training. Analytics collection is opt-in only. Includes local data storage option and data processing agreement (DPA) availability.

Enterprise Plan

Unlimited agents, priority execution, custom templates, advanced workflows, and API access. Your data is never used for AI training. Analytics collection is opt-in only. Includes local data storage, DPA, and dedicated support.

Plan limits and pricing may change. Active subscribers will be notified at least 30 days before any changes affecting their current plan.

AI Output Disclaimer

AI-generated outputs are not guaranteed to be accurate, complete, or error-free. You are responsible for reviewing all AI outputs before using them in any business or personal context.

We do not guarantee that AI outputs will not infringe third-party intellectual property rights. However, Anthropic (our AI provider) provides copyright indemnity under their Commercial Terms for authorized use of their API, which covers outputs generated through our platform.

AI agents may produce incorrect information, hallucinate facts, or generate content that requires human judgment. Always verify outputs before relying on them for business-critical decisions.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Generate content that is harmful, abusive, or violates third-party rights
  • Attempt to bypass usage limits or security measures
  • Resell or redistribute the Service without authorization
  • Use the Service to send spam or unsolicited communications
  • Interfere with the Service's infrastructure or other users' access

Intellectual Property & Content Ownership

You retain ownership of all content you provide to the Service (inputs) and all content generated by AI agents on your behalf (outputs). We claim no ownership over your task data, agent configurations, or generated outputs. The Service itself, including its design, code, and branding, remains our intellectual property.

Anthropic, our AI provider, assigns all rights in AI-generated outputs to us under their Commercial Terms, and we in turn assign all rights in those outputs to you. This means you own what your agents produce.

Limitation of Liability

The Service is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

We are not liable for interruptions or failures of third-party services we depend on, including Anthropic (AI processing) and Supabase (data infrastructure). We are also not liable for AI hallucinations, inaccurate outputs, or decisions made based on AI-generated content that was not reviewed before use.

Indemnification

You agree to indemnify, defend, and hold harmless OHWOW.FUN SAS, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you provide to or generate through the Service. We will similarly indemnify you for claims arising from our breach of these Terms or our gross negligence.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Colombia. OHWOW.FUN is operated by a Colombian SAS (Sociedad por Acciones Simplificada).

In the event of a dispute, both parties agree to first attempt informal resolution by contacting the other party in writing. Each party will have 30 days to resolve the dispute informally. If informal resolution fails, the dispute shall be resolved through the competent courts of Colombia, or through arbitration if both parties agree.

Force Majeure

Neither party shall be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, third-party service failures, pandemics, or other force majeure events. The affected party will provide prompt notice and use reasonable efforts to mitigate the impact.

Termination

You may cancel your subscription and delete your account at any time from your dashboard settings. We may suspend or terminate your account for violations of these terms. Upon termination, your data will be permanently deleted within 30 days. You can export your data before deletion.

Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
